The shutdown has disrupted normal operations, creating uncertainty about whether benefits will be distributed for November. Federal law mandates the administration to provide full and timely SNAP payments, even without a passed budget or continuing resolution.

Legal Challenge in California Federal Court

Filed in the Northern District of California (Oakland), the case — Perrone v. Rollins, 25-cv-09508 — claims that the Trump administration violated the Food and Nutrition Act by withholding benefits.
The plaintiffs’ attorneys argue that the administration is defying court orders requiring continued payment. Two federal courts have already instructed the government to restore the funds, but officials have proposed partial disbursements equal to about half of normal benefits.


Conflicting Signals from the White House

President Trump stated on his social media platform that SNAP benefits would not resume until Congress ends the shutdown.
Hours later, Press Secretary Karoline Leavitt clarified that partial payments would be restored, but only after administrative delays.
The conflicting messages have heightened confusion among recipients and state agencies, which rely on federal guidance to issue benefits.


Potential Impact and Legal Implications

The lawsuit underscores the economic and humanitarian stakes of the prolonged funding lapse.
Lawyers for the plaintiffs argue that millions could face immediate food insecurity if payments are not reinstated soon.
The outcome could determine whether future administrations are legally required to continue social safety-net programs during funding gaps.
If courts rule against the administration, the decision could establish binding precedent reinforcing mandatory welfare obligations regardless of budget impasses.
