Clarity Act Faces Make-or-Break Senate Vote Tuesday as Banks and Democrats Push for Changes

  • The Senate votes Tuesday on a procedural motion to advance the Clarity Act, crypto market structure legislation that has stalled since clearing the Banking Committee in May. With full attendance, at least seven Democrats need to support the bill to overcome a filibuster.
  • Two issues have driven the standoff: banks want a fix preventing interest-like payments on stablecoins, warning of deposit flight from community institutions, while most Democrats have withheld support absent stronger ethics language addressing President Trump and his family’s crypto business interests.
  • Republican bill leaders released updated text late Sunday incorporating an ethics agreement brokered by Senators Thom Tillis and Ruben Gallego that Trump has reportedly agreed to, including letting state attorneys general enforce ethics requirements on federal officials. The update also directs the Treasury secretary to restrict stablecoin rewards if community bank deposit flight becomes substantial.
  • Coinbase CEO Brian Armstrong said regulatory clarity is coming regardless of Tuesday’s outcome, noting the SEC and CFTC have signaled readiness to publish their own rulemaking if the bill fails. Coinbase separately struck a deal with Moov last week giving community banks access to stablecoin capabilities, seen as an effort to ease bank opposition.

What Happened?

Tuesday’s vote is explicitly a procedural one, not final passage — bill co-leader Senator Bernie Moreno emphasized it only ends debate on whether to consider the legislation at all, with amendments still possible afterward. A Democratic aide described Majority Leader John Thune’s framing of the vote as a “free vote” intended to keep the bill alive for further negotiation, with the White House reportedly teasing additional ethics concessions contingent on the preliminary vote succeeding. Opposition remains organized and vocal: the American Bankers Association led nearly 80 banking groups in a letter demanding the bill’s stablecoin interest prohibition be strengthened, and ABA’s Brooke Ybarra said she remains “optimistic that the Senate will ultimately consider an improved Clarity Act.” Democratic Senator Chris Van Hollen was blunt in opposition, posting that the bill is “masquerading as a way to create good regulation” and “we can’t let this pass.”

Why It Matters?

The stablecoin yield fight is the more consequential thread for traditional finance, even though the ethics dispute draws more political attention. Banks are warning, in essence, that if stablecoins can offer interest-like rewards, deposits migrate out of community banks and into crypto rails, undermining local small-business and agricultural lending that depends on that deposit base. The bill’s current compromise — Treasury discretion to restrict rewards if deposit flight becomes substantial — is a reactive backstop rather than a preventive limit, which is why banking groups say it doesn’t fully address their concern. For crypto markets, Armstrong’s comment is the more important signal than the vote count itself: regulatory clarity is coming from the SEC and CFTC independent of Congress, meaning the Clarity Act’s failure wouldn’t leave a pure vacuum, just a different, agency-driven path to the same destination. That reduces the binary stakes markets might otherwise assign to Tuesday’s outcome.

What’s Next?

The immediate marker is whether seven or more Democrats cross over Tuesday — Thune’s “free vote” framing suggests the White House believes enough crypto-curious Democrats will advance the bill to see what further concessions materialize. If the preliminary vote fails, watch whether there’s enough remaining time in this Congress to revive an amended version, which is not guaranteed given the calendar. Regardless of the Senate outcome, the SEC and CFTC’s own rulemaking timeline, reportedly active around September 15 or shortly after per Armstrong, is worth tracking as the alternative regulatory path that proceeds either way. Community bank lobbying, led by the ABA, is likely to intensify further if the bill advances toward final passage without stronger stablecoin restrictions.
