US Probes Singapore Logistics Firm for Smuggling Nvidia Chips to China — 47 Shipments Under Review

  • The US Bureau of Industry and Security (BIS) is investigating Singapore-based Apex Logistics — a subsidiary of Swiss shipping giant Kuehne+Nagel — for its alleged role in smuggling Nvidia AI chips embedded in Super Micro Computer servers to China through a multi-country routing scheme that used false documentation to misclassify restricted hardware as non-controlled goods, in what would be the first major enforcement action against a freight company for participating in the illegal semiconductor trade.
  • BIS is examining 47 specific Apex shipments from 2024, each of which was allegedly labeled by two former Apex employees with a shipping code indicating the hardware was not subject to US export controls — a falsification that, if proved, would mean Apex knowingly facilitated the movement of restricted AI systems through Southeast Asia to Hong Kong and ultimately into mainland China; both employees left Apex shortly after the company was notified of the probe.
  • The alleged smuggling route followed a now-familiar pattern in chip diversion cases: Nvidia-powered servers traveled from Taiwan to the US, then to an Asian destination outside China, before moving to Hong Kong and being driven into the mainland — with BIS’s probe focused specifically on the US-to-Southeast Asia leg, and other governments including Singapore (Apex’s headquarters) and Taiwan conducting parallel investigations into the broader network.
  • Kuehne+Nagel’s shares fell as much as 4.2% in European trading on the news — the biggest intraday drop in over three months — while Apex said it is “cooperating fully” with the investigation; the probe is significant not just for its targets but for what it signals about the scope of the US export enforcement campaign: freight companies, not just end users or chip resellers, are now in BIS’s crosshairs.

What Happened?

Bloomberg reported Wednesday that the US government is investigating Apex Logistics — a unit of Kuehne+Nagel, one of the world’s largest freight forwarders — for allegedly helping route Nvidia AI chips embedded in Super Micro servers to China in violation of US export restrictions. BIS is focused on 47 Apex shipments from 2024, each allegedly mislabeled by two former employees to indicate the hardware was not subject to export controls. The servers traveled from Taiwan to the US, then to Southeast Asia, then to Hong Kong and into mainland China. Apex said it is cooperating fully with the investigation and has introduced enhanced compliance procedures. Kuehne+Nagel confirmed Apex’s cooperation but said the parent company “has not been contacted by the authorities.” The number of Nvidia servers across the 47 shipments is not disclosed publicly; in comparable cases, individual shipments have contained 50 to 60 servers each.

Why It Matters?

The Apex investigation extends the US export enforcement perimeter in a significant way. Prior enforcement actions have targeted chip buyers, resellers, and intermediaries — companies that directly purchase or sell the restricted hardware. A freight company faces a different legal and operational reality: it typically relies on shipper-provided documentation to classify cargo, making it harder to know that a shipment violates export controls unless employees are actively falsifying records, which is what the US alleges here. The two former Apex employees at the center of the probe reportedly assigned false shipping codes to covered shipments — an allegation that, if proved, transforms what might otherwise be a compliance failure into a knowing criminal conspiracy. The warning to the broader freight industry is explicit: BIS is now willing to hold transportation companies responsible for cargo that breaches export rules, which will force every major freight forwarder to meaningfully upgrade AI chip shipment due diligence procedures. Jensen Huang’s May 2025 claim that “there’s no evidence of any AI chip diversion” looks particularly hollow in this context.

What’s Next?

Watch for whether BIS brings a formal enforcement action against Apex — which would be the first such action against a freight company and would set a major precedent for the industry. The number of Nvidia servers actually diverted across the 47 shipments is the key unresolved factual question: a small number of servers represents a manageable compliance failure; thousands of servers in a sustained diversion network would represent a material contribution to China’s AI compute capacity and would dramatically raise the stakes of the enforcement response. Singapore authorities have said they will not tolerate their city-state being used to circumvent other countries’ export controls — watch for parallel action from Singapore’s regulators as well.
