Crypto’s $63 Million Bet Against Sherrod Brown Fails as Democrats Head for Majorities in Both Chambers, Putting Elizabeth Warren in Line to Chair Senate Banking

Clarity Act Faces Make-or-Break Senate Vote Tuesday as Banks and Democrats Push for Changes

  • Crypto’s biggest campaign bet lost. The industry spent an unprecedented $63 million trying to defeat former Senator Sherrod Brown in Ohio, but the latest tally showed the Democrat winning a return to the Senate. In Nebraska, Fairshake spent almost $11 million backing Republican Pete Ricketts, who was clinging to a narrow lead past the halfway mark of the count, bringing the two biggest bets to about $74 million by our calculation.
  • Democrats are projected to control both chambers. The party flipped several Senate seats, including red-state wins for James Talarico in Texas with 59% and Roy Cooper in North Carolina with nearly 59%, and political analysts projected a House margin potentially above 60 seats. That would be a far larger working majority than the handful of seats Republicans held.
  • The committee gavels are the real shift. Senator Elizabeth Warren, widely considered the industry’s greatest enemy in Congress, is likely to run the Senate Banking Committee that must sign off on crypto bills. In the House, Representative Maxine Waters could return to lead Financial Services, though she faces a challenge for the role.
  • Crypto’s allies took hits too. Representative French Hill, who led the stablecoin law and the Clarity Act push as Financial Services chairman, was in a tight race in Arkansas, and Representative Bryan Steil, who led the crypto subcommittee, faced a 4% deficit in Wisconsin late in the count.

What Happened?

Tuesday’s midterms broke Republican control of all three branches of government, with Democrats projected to secure majorities in the Senate and the House next year on a wave of dissatisfaction with President Donald Trump’s administration. Crypto super PACs poured money into supporting Republicans and opposing Democrats even as polls and prediction markets pointed to the losing side. Brown, a longtime crypto critic who formerly chaired Senate Banking, could be given authority over crypto matters, though his seniority was erased by his 2024 loss.

Why It Matters?

For crypto, the change is about who sets the agenda. Lawmakers will no longer be under strong directives from the president to build a crypto-friendly regime and will be free to open investigations that could pull in crypto interests. Democrats in the failed Digital Asset Market Clarity Act talks wanted tighter illicit-finance controls, limits on government officials such as Trump participating directly in the industry, and more consumer protections, and those positions are likely to harden now. The House still has a strong, bipartisan base of crypto support, which keeps it the easiest path for legislation.

What’s Next?

Insiders still hope to make progress on a crypto taxation bill and other targeted topics, but lobbyists hold little hope for another market structure effort. Investors should watch the final committee assignments, especially Senate Banking and House Financial Services, and the last calls in races involving Hill, Steil and Ricketts. Any investigations launched by new Democratic chairs would be the clearest early signal of how much tougher the environment will become.
