The Same Week Washington Funded a Gas Pipeline Into New England, It Moved to Reopen a Wind Permit Serving the Same Region

  • The Justice Department asked a federal court to remand the Interior Department’s approval of the construction and operation plan for the New England Wind Project, allowing the agency to make a new decision. BloombergNEF values the project at $14.6 billion, and it is designed to supply electricity for more than 900,000 Massachusetts homes.
  • It is the second such request this month, following a move to revisit Ørsted’s Rhode Island wind farm permit.
  • Both arrive in the same week that the Energy Department announced up to $42 million of Defense Production Act funding for the 125-mile Constitution Pipeline carrying gas to the northeast. One action adds gas supply to the region, the other reopens the approval for a non-gas alternative serving the same demand.
  • The bipartisan permitting reform deal is the collateral risk. Democrats and Republicans agreed to reform infrastructure approvals including assurances for wind and solar, and Bloomberg reports these moves threaten that agreement.

What Happened?

The project is developed by Avangrid, a subsidiary of Iberdrola, which did not immediately respond to a request for comment. Pasha Feinberg, an offshore wind strategist at the Natural Resources Defense Council, said it is long past time for the administration to recognise that its approach to clean energy is backfiring, that customers’ electricity bills keep rising, and that the country cannot meet growing electricity demand because of these actions.

Why It Matters?

The remand mechanism is the part investors should understand, because it is quieter than revocation and harder to contest. Asking a court to send an approval back to the agency does not strike the permit down; it returns the decision to officials who may reach a different conclusion. That means a granted federal approval is not a settled asset, and a project financed on the strength of one carries political risk for its entire construction period. The same lesson is visible from the other direction in New Mexico, where environmental groups forced Oracle into a force majeure claim over water and air permits. Permits are now contestable from both ends of the political spectrum. The threat to permitting reform is the broader cost and it cuts against the administration’s own priorities. Reform is what would speed approvals for gas pipelines, transmission lines and data centres as much as for wind, and the bipartisan deal exists because every category of infrastructure is being delayed. Roughly $68 billion of data centre projects were blocked or delayed in a single quarter, and AEP says it needs 63 gigawatts of new capacity by 2030. If the agreement collapses because wind assurances are not honoured, the gas and grid projects the administration wants will face the same obstacles. On the regional arithmetic, New England’s constraint is genuine. It burns carbon-intensive fuel oil for power during winter freezes, heating costs are expected to rise 21% this winter, and electricity demand is growing. A pipeline and a wind farm are alternative answers to that constraint. Pursuing one while reopening the other leaves the region with less supply than either policy alone would deliver.

What Next?

The court’s response to the remand request determines whether Interior reconsiders, and a new agency decision could take any form. Watch whether the bipartisan permitting bill survives, since it may reach a vote in the lame-duck session and is the constructive route for every kind of infrastructure. For Iberdrola, the question is whether the project’s financing and timeline can absorb further regulatory uncertainty. For New England, winter supply is the practical consequence.
